(a) Consider Approval of Release of Restrictions on a Summers Walk
Town Attorney/Affordable Housing Manager Cindy Reid
Summary: Consider approval to release the Town Affordable Housing Deed Restrictions to allow substitution of those proposed by AJC and Habitat for the Hope to Home Program and authorize the Town Manager to sign any documents related to this request such as the Memorandum of Understanding (MOU) with the joint agency.
(b) Certified Local Government (CLG) Historic Preservation Model Ordinance Planner Lindsay Laird
Summary: The Town of Davidson was recently designated as a Certified Local Government (CLG) by the State Historic Preservation Office (SHPO). In North Carolina, governments which qualify for certification must have an active and legally adequate historic preservation commission, and must meet the federal requirements for certification. The CLG Model Ordinance is a document drafted by SHPO to be used as a guide for local historic preservation commissions. The Historic Preservation Ordinance (attached) was drafted using the state model ordinance language with Davidson-specific references. The purpose of working to adopt a version of the Historic Preservation Ordinance is to ensure that the town enforces appropriate state and federal legislation for the designation and protection of historic properties. The draft ordinance clearly outlines procedures for designating Historic Landmarks and Local Historic Districts, clarifies the process for Certificates of Appropriateness, and expands the powers and duties of the Historic Preservation Commission in accordance with state statute.
The Historic Preservation Ordinance draft is being presented to the board of commissioners as an FYI. This is a part of the board of commissioners’ strategic plan as it relates to historic preservation.
(c) Consider Approval of Stub Road and Greenway Agreement
for River Run Phase V
Town Attorney Cindy Reid
Summary: The Master Plan for River Run Phase V showed a right of way (stub road) that was to be the future connection through to the Alan White property to Davidson East should it ever develop. Subsequent to master plan approval, the White property was placed in a permanent conservation easement. The approved engineered drawings for the stub road call for street construction to a point approximately 92 feet south of the southern right of way of Stuttgart Road. River Run has constructed the stub road to approximately 40 feet south of the southern right of way of Stuttgart Road. Because the White property is highly unlikely to be developed, there is no significant public benefit at this time which would result from construction of the stub road to the White property line.
In the proposed agreement, the town releases River Run from its obligation to construct the remainder of the stub road and River Run agrees, instead, to construct an extension of the greenway trail to connect to Davidson East as shown on the attached map. The town is not abandoning the right of way; it is only releasing River Run from its obligation to construct a portion of the stub road. In addition, the town proposes to grant an encroachment to the owner of Lot 78 because a private driveway was constructed into the right of way. The town may terminate the encroachment agreement if the White property ever develops.
(d) Consider Approval of Beaty Park Phase 1 Design Funding

Summary: After an exhaustive public input process led by a citizen task force appointed by the board, the town-owned land on Beaty Street has been formally approved as Beaty Park. In March of 2019, Resolution 2019-14 (attached) was approved by the town board adopting the recommendations from the Park at Beaty task force and directing staff to proceed on next steps regarding Beaty Park. In particular, staff was directed to begin evaluating dam options, draft a conservation easement for the park land, request design funding from Mecklenburg County, and develop implementation strategies for the recommendations.
The town board is requested to authorize staff to proceed with the design phase for
phase 1 of the park concept plan and allocate $150,000 from unassigned fund balance. This project is:
1) A priority project identified via Resolution 2019-14.
2) Ranked by the town board as one of the priority projects for potential 2017 general obligation bond funding.
3) An item the town board indicated they would like to see addressed in this calendar year.
(e) Consider Approval of Davidson-Concord Road Turn Lane Extension Project

Summary: In response to many citizen complaints, the town board had indicated a desire to work with NCDOT to extend the right-hand southbound turn lane on Davidson-Concord Road at the highway 73 intersection. The highway 73 widening project includes improvements to this intersection. However, that project is not slated to start until 2023 or 2024 and will take three years to complete. So in this interim period, NCDOT advised that the town could improve this intersection at the town's expense.
The board will consider authorizing staff to proceed with the project, secure NCDOT approval, and appropriate $125,000 from unassigned fund balance for the project. If approved, a reimbursement resolution will be added to the October 22 agenda so that the funding for this project could be eligible for reimbursement from the 2017 general obligation bonds.
(f) Miscellaneous/Open Discussion
Summary: This is an opportunity for commissioners to present or discuss any topics not previously listed on the agenda.
