Davidson Board of Commissioners Virtual Meeting Tuesday, December 8, 2020
The Town of Davidson Board of Commissioners will hold a virtual meeting on Tuesday, December 8, 2020 through the Zoom virtual platform and streamed live on YouTube.
The meeting will be called to order at 6:00 pm and the board will enter a closed session. The open meeting will resume at 6:30 pm.

IV. TOWN OF DAVIDSON COVID-19 RESPONSE
Summary: Town staff and the board of commissioners will continue to discuss the Town of Davidson COVID-19 response and how to protect the public health in Davidson.
V. PUBLIC COMMENTS - The Board shall provide at least one period for public comment per month at a regular meeting.
Providing ample opportunity for the public to engage and participate in the decision-making process by the town board during the pandemic is a top priority. In order to ensure public participation, the following options prior to town board meetings will be available for public comment. These options were developed to allow different technologies to be used ensuring equitable and robust comment opportunities:
• Email: The public will be allowed to comment by sending written comments to firstname.lastname@example.org of no more than 400 words via email that will then be read aloud at the meeting. In keeping with the board’s current procedures, only one (1) three-minute of verbal reading will be allowed per email. The deadline to submit by email is 5:00 pm on Tuesday, December 8.
• Phone: The public will be able to call (704)940-9614 and leave a voicemail message in order to provide public comment. These messages will be played during public comment periods, but will be limited to three minutes. The deadline to submit by phone is 5:00 pm on Tuesday, December 8.
• Speak Up Online Platform: Prior to each meeting, the town will post a question online via Speak Up (https://townofdavidson.granicusideas.com/discussions/) that will allow the public to comment via this method. The comments will be read aloud at the meeting, but limited to three minutes. The deadline to submit by Speak Up is 5:00 pm on Tuesday, December 8.
• Social Media: Prior to each meeting, a social media post will solicit any public comment for the upcoming meeting. These comments will be read aloud at the meeting, but limited to three minutes. The deadline to submit by social media is 5:00 pm on Tuesday, December 8.
Note: If the same comment is made via multiple methods, only one will be used in the meeting with the voicemail taking first priority. Public comment must be submitted by
5:00 p.m. the day of the virtual meeting.
VI. CONSENT - Consent items are typically non-controversial and routine items. Prior to the board's adoption of the meeting agenda the request of any member to have an item moved from the consent agenda to old business must be honored by the board. All items on the consent agenda must be voted on and adopted by a single motion.
a. Consider Approval of Draft November Meeting Minutes
Summary: Draft Meeting Minutes from November 10 virtual regular meeting and the November 17 virtual special meeting.
b. Consider Approval of Ordinance 2020-08 and Consistency Statement: Changes to the Davidson Planning Ordinance (Section 14.18 and 15.31.1.D, “Appeals and Variances”)
Summary: In 2019, the North Carolina General Assembly adopted a complete reorganization of the state’s planning and development regulations creating a new statute chapter “160D.” The purpose of the new Chapter 160D is to consolidate county and city regulations into one unified chapter and to reorganize development regulation statutes into a more logical, coherent structure. All towns in the state have until July 1, 2021 to make the necessary changes to their planning ordinances. Ordinance 2020-08 amends Davidson Planning Ordinance Section 14.18 and 15.3.1.D “Appeals and Variances”.
c. Consider Approval of Ordinance 2020-09 Helper-Walley House (603 N. Main Street) Historic Landmark Designation
Summary: Ordinance 2020-09 designates as a historic landmark the property known as the “Helper-Walley House” located at 603 N. Main Street, including the exterior of the house, and the land associated with Tax Parcel Number 00326313.
d. Consider Approval of Ordinance 2020-10 Johnson-Sherrill (21515 Shearer Rd.) Historic Landmark Designation
Summary: Ordinance 2020-10 designates as a historic landmark the property known as the “Johnson-Sherrill Farmhouse” located at 21515 Shearer Road, including the interior and exterior of the house, and the land associated with Tax Parcel Number 00305103.
VII. OLD BUSINESS
a. Discuss NCDOT Project U-5873 Potts/NC 115 Roundabout Update

Summary: The Davidson Board of Commissioners will continue the discussion with representatives from NCDOT regarding project U-5873, Potts/NC 115 Roundabout.
At the July 28, 2020 virtual regular meeting, the board of commissioners requested NCDOT to study the reduction of the multi-use path width along the 200-foot section and provide additional information. Concurrently at that meeting, the Town of Cornelius was asked to consider the request to reduce the width of the multi-use path. NCDOT studied the 200 foot section and then NCDOT, Town of Davidson, and Town of Cornelius staff met virtually to discuss the results. After receiving this information, the Town of Cornelius discussed this potential change and the Cornelius town manager informed town staff that the Town of Cornelius will proceed with the project as currently designed and not make the requested change. This item is for discussion only.
b. Consider Approval of Proposed Water/Sewer Extension for Boulder Rock Loop
Master Plan (18647 Davidson-Concord Rd.)

Summary: Under the town’s agreement with Charlotte Water, Davidson Board of Commissioner approval is required for any water and sewer extension (extension of water and sewer lines to serve a property that is not a connection to existing lines adjacent to a property) to service a property. Palillo Holdings, LLC proposes developing a master plan consisting of 15 units (11 single-family, 4 duplex units) on 5.81 acres with 45% open space.
The board is asked to consider a motion approving a water and sewer extension for the Boulder Rock Look Master Plan (18647 Davidson-Concord Road).
c. Consider Approval of Proposed Water/Sewer Request for East Rocky River Master Plan (15016 East Rocky River Rd.)

Summary: Under the town’s agreement with Charlotte Water, Davidson Board of Commissioner approval is required for any water and sewer extension to service a property (extension refers to construction of water and sewer lines to serve a property; connection refers to improvements to existing lines on or adjacent to a property). It has been determined by Charlotte Water that the East Rocky River Rd. Master Plan requires both water and sewer extensions. Developer Andy Wilfong proposes six single-family homes on 5.507 acres with 70% open space.
The board is asked to consider a motion approving a water and sewer extension for the East Rocky River Master Plan (15016 East Rocky River Road) based on the current Master Plan provided that such current Master Plan that has been submitted to the town is given final approval by the planning department.
d. Discuss Passive Recreation Use Policy and Horsepower Limitation for

Summary: The Davidson Pointe neighborhood had requested that the horsepower limitation for boats at their neighborhood dock as required by their approved master plan be removed. After the November 10 meeting this request was withdrawn by the neighborhood.
At the November 10 board meeting, the town board reached a consensus to continue with the long-standing existing policy of passive recreation uses on Lake Davidson. The horsepower limitation for the neighborhoods in Davidson is in keeping with this overall policy.
The town board is asked to vote to affirm the existing passive recreation use policy direction and instruct staff to implement a plan for beginning the dialogue between the Town of Davidson and Town of Mooresville to formalize a joint passive recreation use policy direction for Lake Davidson and instruct staff to inquire with the Lake Norman Marine commission about options to support this passive recreation use policy direction for Lake Davidson.

a. Discussion of Changes to the Davidson Planning Ordinance (DPO) requested by
The Pines at Davidson

Summary: The Pines at Davidson contacted Planning Staff regarding the possibility of installing gates at their facility due to security concerns and the potential of the Covid-19 pandemic negatively affecting the population of the community. The Pines feels that the population of their residents is the most vulnerable to the pandemic. While various measures and controlled visitor access have been implemented, The Pines management does not feel these measures are the most effective or efficient way to control access to the facility.
This item is for discussion only and a representative from The Pines will be present during the meeting. Next steps include a tentative public hearing at the board of commissioners January 12, 2021 virtual work session, a recommendation by the Planning Board at their January 25, 2021 virtual meeting, and action by the board of commissioners at the February 9, 2021 virtual work session.
b. Growth Management Planning Board Committee Update

Summary: In response to public feedback on the proposed targeted conditional zoning growth management tool, the board of commissioners directed the Planning Board to form a committee to explore other viable growth management tools and to reevaluate targeted conditional. The committee includes four members from the Planning Board. This discussion constitutes the first report from the committee. This is for discussion purposes only.
c. FY2021 Revenue Update

Summary: The FY2021 revenue projection was reduced to adjust for the possible effects of the COVID-19 pandemic. The board requested staff to periodically provide updates on revenue projections and consider amendments to the budget in January 2021.
This item is for discussion only. Staff will provide a revenue update and recommended expenditures at the January 12 virtual work session, and the board will consider budget amendments at the January 26, 2021 virtual regular meeting.
